- In accordance with Section 62-1959, Zero Lot Line Subdivisions, (c) Design Standards, (4) Maintenance access easements: a 5-foot maintenance easement is granted to all unit owners for the maintenance of their walls, roofs, fascia, and soffits.
Meadows South Fining Process
- A homeowner may be issued a "Violation Notice" for any non-compliance with the Association's governing documents or its rules & regulations.
- The Violation Notice will provide include a description of the violation, the required cure date, and the fine amount & schedule if not cured by the specified date.
- If fines accrue due to failure to cure, the Board will present the recommended fines to the Fining Committee at a duly noticed meeting of that committee. The unit owner will be notified via US mail. The Association will present the recommended fine(s) to the Fining Committee and ultimately determine whether the fine(s) may be imposed or not.
- If not allowed, the proposed fine(s) cannot be imposed on the unit owner.
- If allowed, the unit owner will be notified via US mail and be given thirty (30) days in which to pay the fines in full.
- If not paid within thirty days, a Claim of Lien will be filed with the Brevard Clerk of Court at a cost of $300 and the unit owner given ten (10) days to pay the fine and Claim of Lien in full. 18% interest per annum will begin after the end of the 10-day period.
- If not paid-in-full within ten (10) days, collections of the fines & lien costs will be turned over to Association legal counsel where the foreclosure process will begin to collect all amounts due.
